Terms of Service

These terms govern the use of MIDA, available at midamenu.com and operated by MIDA. By creating an account you accept them. If you do not agree, please do not use the service.

1. The service

MIDA lets restaurants, cafés and other businesses create a digital menu with a QR code and, depending on the plan, a website, hosted at an address like your-name.domain. The features available depend on the plan you choose, described on the pricing page.

2. Your account

• You must give accurate information and an email address you control.
• You are responsible for keeping your password confidential and for what is done with your account.
• You must be at least 18 and have the right to represent the business you publish.
• Tell us quickly if you think your account was used without your permission.

3. Subscription and payment

• MIDA is a paid subscription service. Prices and what each plan includes are shown on the pricing page.
• Payments are processed by our partner Lemon Squeezy, which acts as the official seller and may add applicable taxes depending on your country.
• The subscription renews at each term until you cancel it.
• You can cancel at any time from the subscription management area. Cancellation takes effect at the end of the period already paid: you keep access until then.
• Unless the law requires otherwise or we decide to make a goodwill exception, amounts already paid are not refunded.
• We may change our prices for future periods, with advance notice.

4. When a subscription ends

When your subscription ends, your menu and website stop being publicly available. Your data is kept so you can resume by renewing, until you ask for it to be deleted.

5. Your content

• You remain the owner of what you publish: text, photos, logo, menu, prices.
• You allow us to host and display this content only to run the service for you.
• You confirm you have the right to use this content (photos, trademarks, text) and that it does not infringe anyone's rights.
• You alone are responsible for the accuracy of what you publish, including prices, opening hours and allergen information.

6. Rules of use

You must not:

• publish content that is illegal, misleading, hateful, violent or contrary to public morals;
• impersonate another person or business, or pick an address that could be confused with a trademark that is not yours;
• try to disrupt the service, access data that is not yours or bypass the limits of your plan;
• use the service to send unsolicited messages.

Some address names are reserved for running the service and cannot be chosen. If these rules are broken we may remove content or suspend an account, after warning you where possible.

7. Availability

We do our best to keep MIDA available at all times, but we cannot promise it will never be interrupted (maintenance, a provider incident, force majeure). We recommend keeping a copy of your menu.

8. Liability

To the extent permitted by law, MIDA is not liable for indirect losses (for example lost revenue) caused by using or being unable to use the service. Our total liability is limited to the amount you paid for the service over the previous 12 months. Nothing in these terms limits a liability that cannot legally be limited.

9. Intellectual property

The service, its software, its design and the MIDA brand belong to their publisher. Your subscription gives you a personal, non-transferable right of use for its duration, without any transfer of ownership.

10. Personal data

How we process your data is described in our privacy policy, which is part of these terms.

11. Changes

We may update these terms. The date of the update is shown at the top of the page. For important changes we will warn you in advance. By continuing to use the service after that date you accept the new version.

12. Governing law

These terms are governed by Moroccan law. If a dispute arises, we first look for an amicable solution by talking with you. Failing that, the competent Moroccan courts will hear it, without prejudice to any consumer rights you may have in your own country.
